Up To Date Comments to the Law on Public Procurement Made Available
In association with the Ministry of Economic Development and Trade of Ukraine, the Project prepared and presented a detailed commentary to the newest version of the Law of Ukraine on Public Procurement to reflect the recent amendments after the new Law came into force on 1 August 2016. This Document is primarily intended for public procurement practitioners, including regulatory agencies, providing them with a suitable tool to ensure an efficient and consistent practice of the public procurement procedures.
The Manual comprises detailed practical comments to the main provisions of the Law on Public Procurement and key secondary legislation acts. The comments are based on a careful expert analysis and performance of the Law regulating public procurement, as well as information and insights obtained in course of cooperation with representatives of the Public Procurement Regulation Department of the Ministry of Economic Development and Trade of Ukraine, the State Treasury Service of Ukraine, the State Audit Service of Ukraine, the Antimonopoly Committee of Ukraine, State Enterprise “ProZorro” and certain contracting authorities and in procurement stakeholders.
The Document also concludes that there is a need for further modification of certain provisions of the Law to harmonize discrepancies with EU standards in accordance with the EU approximation objectives for 2017 of the Government’s Public Procurement Reform Strategy/Road-Map.It is described in detail in the Report on the Gap Analyses of the Ukrainian Public Procurement Legislation Vis-À-Vis the EU Public Procurement Directives in December 2016.
